Transportation Contract

Required

The Independence School (“School”) offers morning and afternoon transportation for a fee to our (“Students”). The vans are owned or leased by the School and operated by School Employees. The van routes are predetermined by the school. Seating is limited and is on a first come, first served basis. Note that students must be in Kindergarten. Please reach out to Jen Hayes, Auxiliary Programs Manager with any questions. 
 

Fee Schedule
The transportation fee is per route for the entire 2024-2025 School Year. Payment is due by September 1, 2024. Please send a check made out to The Independence School.

Morning Route = $1,495.00
Afternoon Route = $1,495.00
Note: We plan to continue to support the modified afternoon van route that was in place last year if this works for the families on the van for the 2024-25 school year.

Terms

For and on behalf of the above Student, the undersigned accepts the following terms and conditions for acceptance of the Student at School:

  1. The undersigned, for themself, and the Student accepts and agrees to support the School’s Mission and Belief Statements.
  2. The undersigned agrees that a constructive working relationship between School and a Student’s parent(s)(or guardian) and adherence to the School’s code of conduct, as may be amended from time to time, is essential for a positive experience for both the Student and the School community. If School determines that the actions or inactions of a parent(s)(or guardian) or Student seriously interferes with or is disruptive of this experience or the student-school relationship is no longer mutually beneficial, continued transportation of the Student may be terminated or withdrawn by the School.
  3. The transportation fee must be paid by the date defined in the Fee Schedule. The undersigned agrees to abide by the financial terms included.
  4. If a written letter of intention to withdraw a Student is received by School prior to September 1, 2024, this contract will be terminated without further financial obligation on the part of the parent or guardian; however, if Student is withdrawn for any reason after September 1, 2024 the undersigned agrees to pay $500 or the prorated amount; whichever is greater.
  5. A 1.5% per month (18% annual rate) service charge is payable on all past due balances.
  6. Returned checks made payable to The Independence School will be subject to a $20.00 non-sufficient fund fee.
  7. School may consider any failure to promptly pay the transportation fee when considering whether to offer future contracts. In addition, in the event that the School takes legal action to enforce this Contract, the undersigned shall be responsible for the School’s attorney’s fees and costs.
  8. In case of an emergency, School has the right to make necessary decisions concerning the care and safety of the individual Student.
  9. Until such time as the undersigned provides the School with a signed Family Educational Rights and Privacy Act (FERPA) form, the undersigned permits the School to use, in whole or in part, photographs, videos, written extractions, and voice recordings of the Student for the purpose of internal or external illustrations, publications, and web content including social media. Further, the undersigned hereby permits the School to notify local media of the Student’s academic, athletic, and other special achievements. Any such FERPA forms may be provided by any one of the Student’s parents and/or guardians.
  10. The School will provide morning/afternoon transportation services to the Student.
  11. The School’s duties and obligations under this Transportation Contract shall be suspended immediately, without notice, during all periods that the School is closed because of force majeure events including, but not limited to, any fire, act of God, hurricane, war, governmental action, act of terrorism, epidemic, pandemic, State of Emergency, or any other event beyond the School’s control. If such an event occurs, the School’s duties and obligations in this Trasportation Contract will be postponed until such time as the School, in its sole discretion, may safely reopen. During any such period of closure, the School may elect, at its sole discretion, to provide remote educational services, in a form and amount to be determined by the School, and which need not equal or approximate the educational services provided pre-closure. Closure due to one or more of these events, with or without the provision of remote educational services, does not relieve the undersigned of any financial obligations under this Transportation Contract. In the event that the School is closed for any period of time due to an event under this clause, regardless of whether remote educational services are provided, the School is under no obligation to refund, or excuse future payment of, any financial obligations under this Transportation Contract.
  12. Please note that only backless booster seats and high back booster seats (not car seats/harness boosters) will be allowed in the van for easy removal from the seating area. Children must meet the State of Delaware Car Seat Guidelines: http://ohs.delaware.gov/carseat3.shtml. Booster seats will be stored in the van for morning pick up so we ask that a labeled booster seat be provided for each child if needed. School vans have regular seatbelts and the student must abide by all seatbelt laws.
  13. This Transportation Contract is to be construed under the laws of the State of Delaware.
  14. This Transportation Contract must be fully completed and executed in order to be valid.
